* All donations received here prior to August 15, 2026 will be earmarked exclusively to fund a separate legal case to address the irregularities in the 2026 Pacifica election. We will be asking for a temporary restraining order (TRO) to halt the proceedings until their legal status is settled.

Our attorney, Mark Eisenberg, filed a brief on June 1, 2026 appealing the decision of the Trial Court to dismiss our motion to intervene. You can find the Appeals brief here.
It is a powerful argument why the Judge made an error when she dismissed our case in the Superior Court and why the Appeals Court should overturn that decision and send the case back to the trial court so that the argument against the collusive settlement agreement can finally be heard.

Current Status of Appeal
All paper work in the Appeal has now been filed. This includes the original Notice of Appeal, the Appeal Brief, the response to our brief by Pacifica’s attorney, and our response to Pacifica’s objections. We are now waiting for the Appeals Court to set a hearing date for in person oral arguments. This is expected in the next few weeks.
The 2026 Pacifica elections
The debacle of Pacifica’s 2026 elections.
The Pacifica election cycle that is now underway is based on the bylaws imposed on Pacifica by the collusive settlement agreement from 2025. It has no more legitimacy than the 2025 bylaws. But in addition to its legal status, the 2026 election cycle has turned into a travesty. Since the election cycle began a few months ago numerous complaints have been received about the undemocratic and arbitrary procedures being implemented in this election. The complaints come from a variety of individuals who ae alleging that their rights are being violated. Overall, the complaints paint a picture of arbitrary and incoherent decisions that amount to voter suppression and the unfair treatment of certain candidates, the arbitrary disqualification of candidates and numerous other apparent violations of the basics of conducting a democratic election. The Pacifica Mission Coalition, a group that has coordinated the efforts of candidates opposed to the New Day bylaws for Officer positions on the Pacifica National Board, is working in cooperation with the Pacifica Democracy Project to pursue all legal remedies to the travesty of this election.
A New Donation Campaign for a new legal case
To address the problems in this election a new legal case is now being strongly considered. To get started we need to begin a new fund-raising cycle. Our initial goal for the proposed new legal case is $15,000 immediately just to get started and an additional $10,000 shortly thereafter. To accommodate this financial requirement, we starting a brand-new emergency fund drive starting today.
Your donation to the MightyCause website will be earmarked for at least the next two weeks exclusively to fund legal remedies to the Pacifica election. It is vital that we meet the fund-raising goal as soon as possible.
